Including Land Surveyor’s Services in Alberta Real Estate Transaction

Importance of hiring land surveyors in real estate transactions

It is important to hire the services of a land surveyor while venturing into real estate purchase in Alberta, Canada just as it would have been for real estate purchasing in any other place. Since the real estate has boundaries and property boundary determination is the area of activity of the land surveyors, indeed, a very crucial role is played by the land surveyors in property transaction. Without help from the land surveyors you just cannot reliably ascertain the boundaries of the property being purchased by you.

You, the property buyer, certainly need to know where the boundaries of the property lie and where exactly the building and various improvements have been made in relation to the boundaries. It is here that the need of hiring the land surveyor’s services arises- in determining the location and measurement of boundaries and in preparing the Real Property Report (RPR).

The services offered by the land surveyor

The RPR is a diagram and also a statement regarding the property and the location of buildings, improvements and easements concerning property. While proceeding to prepare this report the land surveyor searches the plans of the property and property title and then evaluates the technical information about easements. The surveyor also visits the site and determines the property boundaries.

This boundary location may not be very easy. The boundaries could have been established several years (or even decades) ago and the markers or pins may have been destroyed or may have gone underground. The land surveyor may even need to find the boundary by carrying out measurement from the nearest known survey marker which can lie anywhere between a few meters off to some hundreds of meters away.

Then there is to be measured the location of the buildings and erections relative to the boundaries. Difficulties often crop up here. There may be some neighbor’s garage or some other improvement built upon the property by crossing the property line. Such matters can not only be difficult to manage but can prove to be costly too.

The improvements are also to be measured relative to easements or the right-of-way. Due consideration needs to be given to matters like the location of the buildings/erections relative to gas lines, utility corridors, pipelines, roadways, electrical transmission structures etc.

Upon completion of all measurements the land surveyor creates a diagram of the property with all findings- the RPR. This also contains the surveyor’s written opinions about the evidence collected. The RPR is sent to the municipality for verification about compliance with municipal bylaws.
